General Condition

Introduction


Every year, the French Association of the International Film Festival organises the International Film Festival in Cannes (hereafter referred to as the "Festival de Cannes"). The Festival de Cannes aims, in a spirit of friendship and universal cooperation, to reveal and promote quality works, with a view to helping the cinematic arts evolve and fostering the development of the global film industry.


These general registration conditions set out to specify the terms and conditions of participation in the Festival de Cannes for film professionals, journalists and cinéphiles (hereafter referred to as "Participants"). Access for Participants registered for the Festival de Cannes, is subject to full compliance with the rules and conditions outlined below.




Accreditations: deadlines and conditions


The Festival de Cannes issues three types of accreditation:

  • “Festival” accreditations are reserved for professionals of the film industry, and granted upon proof of relevant professional activity. Requests must be submitted by April 15th. However, the Film industries representatives who have their professional activities in the following fields are invited to register to the Marché du Film: Sales agents, TV broadcast, Buyers' Reps, Consulting, Distribution, Film Law, Film Financing, VOD platforms.

  • “Press” accreditations are reserved for journalists with proven experience of covering film news. Requests must be submitted by March 31st.

  • “Cinéphiles” accreditations are strictly reserved in priority and subject to availability, for film school students and film associations, and delivered upon presentation of justifying documents. Requests must be submitted by March 1st.


The Festival de Cannes reserves the right to refuse the registration of Participants:

  • who do not meet the professional admission criteria, without having to justify its decision;

  • who have been excluded in previous years;

  • who are underage. Exceptions may be granted for minors after examination of their request by the Festival de Cannes' services, and provided that the minor's badge is linked to another badge of an adult. Minors who have obtained such an exception will only have access to the professional areas if they are accompanied by an accredited adult. As films shown do not have content ratings, it falls to the responsability of the accompanying accredited adult to determine if a film is suitable for the minor. In addition, parents can request a badge for their breast-fed infants if they need to circulate with the infant in the professional areas;

  • any person or company with a negative balance at the Festival or the Marché du Film, or any of our associated hotels. Such Participants will be refused registration privileges to the Festival, until the debts are recovered;

  • any people or company holding their Professional activities outside the Palais des Festivals not having agreed with the Marché du Film on the subscription to the "Croisette Package", a pack designed for exhibitors based outside the Palais des Festivals;
     
  • who submitted a request after the deadline.  


Accreditation requests which respect the above deadlines are free of charge. From April 15th, and until 1st May, a late festival accreditation procedure will be in place for professionals, with an application fee of €100 (including VAT) payable on the day the request is submitted, failing which it will be automatically rejected. This fee will not be refundable, regardless of the response to the request, including in the event of a negative response or cancelled request.




Registration procedures


Accreditation requests must be made online via the official Festival de Cannes website.

As certain requests may be refused on the grounds mentioned in Article 2 of these general conditions, a Participant's registration is confirmed only after validation of their request by the accreditation services of the Festival de Cannes.

If the Participant is a citizen of a country for which a visa is required to travel to France, it is the Participant’s responsibility to follow the required procedure and be fully prepared for the timelines involved. In this case, the Participant will be able to download a visa letter available online through her or his personal account, as soon as the request is validated. Any fraudulent use of this invitation letter is liable to prosecution.

 



Badges and access


Badges


Each Participant will receive a personalised badge on their arrival in Cannes.


A badge is strictly personal and under no circumstances may be passed, lent or exchanged, to someone else, at the risk of losing all rights of access.


Each Participant must wear their badge visibly when entering the Festival zone.


In the case of lost or stolen badges, the Festival de Cannes will, in certain cases, issue a duplicate. In this case, the new badge will cost €50, including VAT.

Access to sessions


Access to the various sessions of the Festival is by badge or invitation.


The invitations issued are free of charge, and are exclusively attributed by the Festival de Cannes. No tickets are sold and invitations are strictly personalised and non-transferable – even those which are free of charge. Any misuse is liable to prosecution.




Participant commitments


Permissions and prohibitions for visual and/or sound recording


The Participant confirms and accepts that their presence at any Festival event may result in photographic, televised or digital reproduction in any media outlet for either promotional and / or commercial purposes.


It is strictly forbidden to use a digital camera or mobile phone to film the Red Carpet procedure or any official event organised by the Festival in the screening rooms (opening and closing ceremonies, films in Selection, cinema lessons and Master Classes), as well as at other Festival events (evenings and official dinners, speeches, etc.).


It is also strictly forbidden to film or photograph invited public persons. In general, each Participant expressly agrees not to act, in any form whatsoever, in violation of the provisions of the Intellectual Property Code governing copyright and its related rights.

Dress code and general conduct


The Participant undertakes to wear appropriate clothing, particularly at screenings for which gala dress is requested.


Out of respect for the organisation of the Red Carpet schedule procedure, invited guests at sessions must agree not to take photographs or film on the steps of the Palais des Festivals, especially selfies.


The Participant undertakes to respect safety, order and police regulations and to behave respectfully towards Festival de Cannes employees and other Participants. Improper behaviour (insults, violence, damage to facilities, disturbance of screenings and other events) will result in the permanent withdrawal of the Participant's badge and their exclusion from the event.



Interruption or cancellation of the event 


The Participant entrusts the organiser to decide whether the event should be interrupted or whether there is a threat to public security and undertakes not to lodge a complaint at a later stage.


More generally, the interruption or cancellation of the event, for whatever reason, must not give rise to any claim or compensation from the organisers in respect of immaterial damage.




Data protection

The information collected for the registration is processed by the Association Française du Festival International du Film and is essential in the processing of his/her request.

This information and personal data are also stored for security purposes, in order to comply with legal and regulatory obligations.

They will be kept as long as necessary for the execution of the work required. The Association Française du Festival International du Film is in charge of the processing (the “Controller”), 5 rue Charlot, 75003 Paris, privacy-festival@festival-cannes.fr.

Access to personal data will be strictly limited to the employees of the Controller who are authorised to process them as part of their duties. The information collected may be communicated to third parties linked to the company by contract for the performance of subcontracted tasks, without the attendant's authorisation being necessary.

In accordance with Law No. 78-17 of 6 January 1978 on data processing, data files and freedoms, as amended by Law No. 2004-801 of 6 August 2004, and by European Regulation No. 2016/.679, the attendand has the right to access, correct, delete and transfer data concerning him/her, as well as the right to object to processing for legitimate reasons, rights that he/she can exercise by contacting the data controller at the postal or e-mail address mentioned above, attaching a proof of his/her valid identity. In the event of a complaint, the customer may contact the Commission Nationale de l’Informatique et des Libertés (CNIL).



Respect for general conditions


Participation at the Festival de Cannes implies acceptance of the rules and regulations previously stated. Any company, institution, association, organization or individual who registers one or more third parties at the Festival de Cannes, undertakes to pass on these general conditions and ensure their acceptance by the beneficiary or beneficiaries and guarantees that the said conditions will be fully respected by the accredited third party(ies).


The information provided by the Participant will be used in accordance with the French Data Protection Act of 6 January 1978. Rights of access and rectification may be freely exercised. Any violation of these rules and regulations - as well as any defiance of security, order or the police - could result in the revocation of the Participant’s badge and subsequent exclusion from the event. The organization also reserves the right to take legal action against the Participant in order to recover or repair any damages they may cause.




Jurisdiction and competent law


Any dispute, which may arise between the Participant and the Festival de Cannes will be subject to the exclusive jurisdiction of the Courts of Paris, only French law being competent.
